Forres Angling Association Constitution

  1. The name of the Association shall be FORRES ANGLING ASSOCIATION (hereinafter called “the Association”).
  2. The objectives and purpose of the Association shall be:
  3. a) To acquire by any means considered to be appropriate, the right of angling by rod and line and to make the same available to members.
  4. b) To act as principals or agents in the management of any fishing rights or in the improvements thereof, and for these purposes, to enter into agreement with any body or persons and to implement such agreements.
  5. c) To encourage angling as a sport.
  6. d) To prevent illegal, prohibited or unauthorised methods of angling, taking or destroying fish.
  7. e) Generally, to carry out such procedures or perform any act calculated to give effect to the said objectives.
  8. Membership of the Association shall be considered by payment of the appropriate subscription, amount of which shall be fixed from time to time by members at the Annual General Meetings.  There shall be the following classes of members:

1) Ordinary Members being permanent residents in the town and parish of Forres and in the parish of Rafford who have attained the age of 16 and such other persons or bodies however constituted as the Committee of Management may decide to admit to ordinary membership.

2) When the number of Ordinary Members stated above falls below 220, appointing new Ordinary Members who live within the area designated by the postcode IV36 will make up the balance.

3) Ordinary Junior members being permanent residents in the said town and parishes who have not attained the said age.

4) Junior Members under 16 years of age may join the Association if they live within the area designated by the postcode IV36 without restriction in numbers.

One Member of RAF Angling Club Kinloss shall have voting powers at the Annual General Meeting or at a Special General Meeting if KGAC take a ticket.

Full Ordinary Members shall run the affairs and management of the association.  Honorary and Complimentary Members will have no voting rights at Annual General Meetings.  Junior Members shall have no such rights in the said affairs and management.

  1. Office Bearers shall consist of a President, one or more Vice Presidents, Secretary and a Treasurer. The same individual may hold the office of Secretary and Treasurer.  The Secretary and Treasurer shall have full voting powers only if they are full Ordinary Members of the Association.
  2. Committee members who resign from the committee are illegible to be reappointed to the committee for the remainder of their term in office plus one fallow year.
  3. The management of the affairs of the Committee shall be voted in and conducted by a committee consisting of the President, Vice President or Vice Presidents, Secretary, Treasurer and ten (10) Ordinary Members elected at the Annual General Meeting. If one or more vacancies occur in the committee during a season, the committee shall be empowered to fill any such vacancies by co-option.  A co-opted member will serve only for the season, or part season, for which the member was co-opted but will be eligible for re-election at the next Annual General Meeting.  Of the ten Ordinary Members elected, two shall retire annually by rotation and shall not be eligible for re-election until one year has passed.
  4. The Committee shall have the following powers:

1) To manage, conduct and carry through the routine business of the Association and to decide what special business, if any, should be submitted to a general meeting of members for submission.

2) At committee meetings (9 being the quorum) the President, shall preside and, on a vote in the event of equality, he shall have the casting vote in addition to a deliberative vote.

3) To form, alter and amend from time to time, rules and conditions relating to and upon which angling may be carried out.

4) To terminate Membership of the Association should any Member contravene the said rules and conditions.

5) To enter into on behalf of the Association, any contract, lease or other agreement necessary to carry out any of the objectives and purposes of the Association.

  1. The Annual general Meeting of Members (25 being the quorum) shall be held during the month of November and the ordinary business to be submitted shall include:

 

  1. a) Secretary’s Report.
  2. b) Treasurer’s Report.
  3. c) Fixing the respective amounts of subscriptions for the ensuing year.
  4. d) Appointment of committee members in lieu of those retiring or to fill casual vacancies.
  5. e) Appointment of Secretary, Treasurer and Auditor.
  6. f) The general business considered incidental to the normal running of the Associations affairs.

Any other business shall be deemed special business.  Seven days notice by press advertisement shall be given prior to any Annual General Meeting and such advertisement shall specify generally the nature of any special business to be considered.  A member desiring to put forward special business for consideration must intimate in writing to the secretary prior to the 7th November the nature of such special business.  At any Annual General Meeting, the President (or Vice President should the president be absent) shall preside and, on a vote in the event of equality, shall have a casting vote in addition to a deliberate vote.

  1. A Special General Meeting of Members may be held if the committee so decide, or on the requisition signed by at least twenty-five (25) Members and lodged with the Secretary. Such requisition must specify the nature of the business proposed.  The provisions as to press advertisement and other provisions (excluding the reference to the 7th November) relative to the Annual General Meeting contained in the immediately preceding paragraph shall also apply to a Special General Meeting.
  2. This Constitution supersedes all previous Constitutions. Adopted 4th February 2002.
